Terms of Sale & Use

DAMA PIG is primarily a free kendama search and price tracker. Alongside it, we run a small first-party merch shop selling print-on-demand apparel. These terms cover both: buying from the merch shop, and using the site in general, and buying or selling in Used listings.

Ordering & payment

This section covers the Dama Pig merch shop. Used listings from other people have their own Buyer Protection, described at /used/policy.

  • The merch shop ships to the US, western Europe, and a list of other countries. Pick your region in your cart; if yours isn't listed, get in touch and we'll look at adding it.
  • All prices are listed in USD.
  • Payment is captured at checkout through Stripe. We never see or store your card number.
  • A flat shipping fee for your region is added at checkout before you pay.

Fulfillment & shipping

Merch is printed and shipped by a third-party print partner, not by us directly. Items are made after you order, so nothing ships the same day. Printing typically takes 3 to 7 business days, and transit usually runs another 5 to 15 business days depending on where you are, so most orders arrive roughly 2 to 4 weeks after ordering. Order confirmation and shipping emails come from orders@damapig.com.

Orders shipping outside the US may be charged import duties, taxes, or customs fees by your country. Those aren't included in the price you pay us and are the recipient's responsibility.

Please double-check your shipping address at checkout. If a package is returned or held because the address was wrong or incomplete, we can usually reship it, but we may have to charge the return and reshipping cost.

Using the site

  • Don't scrape, mirror, or abuse the site or its API in a way that degrades it for others.
  • The DAMA PIG name, logo, and site content are ours. Product listings, images, and pricing shown for other kendama brands belong to those brands; we're just linking to and describing what they sell.
  • The site and merch shop are provided "as is," with no warranty of any kind. We work to keep prices and availability accurate but can't guarantee that data pulled from third-party brands is always current.
  • To the extent allowed by law, DAMA PIG isn't liable for indirect, incidental, or consequential damages arising from your use of the site or a merch order.

Text message alerts (SMS)

DAMA PIG Drop Alerts is an optional text-message program. When you tick the text-message box on an alert signup form and give us a mobile number, you agree to receive recurring automated marketing text messages from DAMA PIG about kendama drops and restocks at that number. Consent is not a condition of any purchase.

  • Message frequency varies. Message and data rates may apply.
  • Reply STOP at any time to cancel. You will get one final text confirming you are opted out.
  • Reply HELP for help, or email support@damapig.com.
  • Texts are only sent to US and Canadian numbers.
  • Carriers are not liable for delayed or undelivered messages.
  • How we handle your number is described in our Privacy Policy. Mobile opt-in data is never shared with third parties for marketing.

Used listings

Used listings are kendamas sold by other people, not by Dama Pig. Dama Pig runs the checkout, holds the buyer's payment until delivery, buys the shipping label and refunds the buyer under Buyer Protection. The seller sells the kendama and is responsible for describing it honestly. Dama Pig does not inspect kendamas and makes no promise about their condition beyond Buyer Protection.

Who may sell

You have to be 18 or older to sell. Checking "I am 18 or over" and "I agree to the terms" on a listing is how you accept these terms, and you accept them again each time you list. If we learn that a seller is under 18, their listings are removed, any unshipped order is refunded in full, and they may not list again.

What sellers agree to

  • You own the kendama and have it in hand.
  • Your listing describes it honestly, and the photos are of the actual kendama.
  • Kendamas and kendama parts only, no other skill toys.
  • One kendama or kendama part per listing, and it has to fit in a parcel under 1 lb.
  • You ship only with the label Dama Pig emails you, within 5 days of the sale.
  • Your listing contains no payment details or links. Buyers pay on Dama Pig.

What we may do

We screen listing photos automatically and read reports from buyers. We may remove any listing, cancel any order, or refuse further use of Used listings to anyone who breaks these rules or who we believe in good faith is misusing them, using our own judgment, and without notice when we have to. We may also remove a listing when we get a copyright complaint about it.

Your account

  • One account per person, keyed by your email address.
  • Don't share your sign-in links. Anyone with one can act as you.
  • You are responsible for your inbox.
  • Buying needs no account.
  • We may suspend or close an account for fraud, ban evasion, selling under 18 or breaking these terms. Open orders still settle under Buyer Protection.
  • To close your account, email support@damapig.com. Open orders and disputes finish first.

Buyer Protection

Buyer Protection is a buyer's remedy under these terms. In short:

  • A seller has 5 days to ship, or the order cancels with a full refund.
  • A buyer has 3 days from delivery to report a problem, or can confirm early.
  • A seller has 2 days to reply to a report. A person decides a contested claim within 2 business days, and close calls go to the buyer.
  • A return is free for the buyer. It has to be shipped within 5 days, or the claim closes at day 7 and the seller is paid.
  • A seller has 48 hours after a return is delivered to check that everything is good. Then the buyer is refunded.
  • A seller pays for the return label only when they accept the return, do not reply, or the claim is upheld.
  • A parcel with no delivery 30 days after it shipped is refunded in full. The seller is paid up to $100 then, and the insured value above $100 when the insurance claim pays.
  • If the buyer's bank reverses a delivered order with no claim, Dama Pig carries it until the bank decides.
  • There are no change-of-mind returns.

Buyer Protection applies only when you pay on Dama Pig. Payments arranged on Instagram or anywhere else are between you and the seller.

Fees

Buyers pay a Marketplace fee, and the shipping label unless the seller covers it. Sellers pay a flat $1.50 fee on each sale, taken from the payout. If you choose to cover shipping, the label comes out of your payout too. The rates are on the Used listings policy page.

Getting paid

Three days after delivery, or sooner if the buyer confirms, Dama Pig moves your money to your Stripe account. Stripe pays your bank from there. You set up payouts with Stripe, which collects your name, bank account and, later, tax details; Dama Pig never holds them. If you never set up payouts, you still own that money. We hold your money for you. Email us any time to claim it.

Sales tax

Sellers are responsible for their own tax obligations. Dama Pig gives no tax advice.

The Governing law section below applies to Used listings as it applies to everything else on the site.
